User Agreement

LK Squared Inc. or LK² Inc. ("we", "us"), which owns and operates the seewhosnext.com web site (our "Site" or "the Service"), set forth the Terms of Use which are binding on all users of the Site. By directing your browser to this Site or otherwise accessing the pages of this Site, you accept these Terms of Use. We may change the Terms of Use at any time at our sole discretion. We reserve the right, at our sole discretion, to seek and obtain any other remedies available to it pursuant to any applicable laws and regulations or at equity as a result of your breach of the Terms of Use or any other act or omission by you that gives rise to a claim by LK² Inc.

Right to Use

Your right to use the Site is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion. We may alter, suspend or discontinue any aspect of the Site at any time, including the availability of any Service feature, database or content. We may also impose limits on certain features and aspects of the Site or restrict your access to parts or the entire Site without notice or liability.

Anything that is also fraudulent, misleading, unlawful or violates any law.
• You will not use the Site to dispense, promote or otherwise publish any material containing any solicitation for funds, advertising and/or endorsing, solicitation for goods or services.
• You will not use the Site to distribute or upload any virus(es), spyware, or do anything else that might cause harm to the Site and to other members’ systems.
• You will not use the Site to harvest or collect email address(es) or other contact information of other users by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.
• You will not use the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site.
• You will not register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity.
• You will not impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your age.
• You will not create a false identity on the Site.
• You will not use the Site to dispense, promote or otherwise make publicly available any third party information, including, without limitation, address(es), phone number(s), email address(es), Social Security Number(s), Social Insurance Number(s) and credit card number(s). Privacy

All information submitted to the Site might potentially be publicly accessible. Information about yourself that you don’t want known, keep it to yourself. You are responsible for keeping important and private information about yourself protected. We are not responsible for protecting, nor are we liable for failing to protect, the privacy of electronic mail or other information transferred through the Internet or any other network that you may utilize. Security

We are committed to ensuring that your information is secure. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However while we strive to use commercially acceptable means to protect your PII, we cannot guarantee its absolute security.

Monitoring of Information

We reserve the right to monitor all advertisements, public postings, messages/comments, and images.

Removal of Information

While we do not and cannot review every message/comment or other material posted or sent by users of the Site, and are not responsible for any content of these messages or materials, We reserve the right, but are not obligated, to delete, move, or edit messages/comments or materials, including without limitation profiles, public postings, messages, images that we, in our sole discretion, deem to violate the Code of Conduct set out above or any applicable content guidelines, or to be otherwise unacceptable. You shall remain solely responsible for the content of profiles, public postings, messages/comments, images and other materials you may upload to the Site or users of the Site.

Advertising

You agree to grant LK² Inc. a license for the right to use your images’ or text in the marketing of the Site; this excludes your personal information, such as your e-mail address.

Termination of Access to Service

We may, in our sole discretion, terminate or suspend your access to all or part of the Site at any time, with or without notice, for any reason, including, without limitation, breach of the Terms of Use. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity, or that may otherwise affect the enjoyment of the Site or the Internet by others may be grounds for termination of your access to all or part of the Site at our sole discretion, and you may be referred to appropriate law enforcement agencies.

Our Site may contain links to enable you to visit other websites. However, once you have clicked these links and leave our Site, you should note that we do not have any control over other websites. Therefore, we cannot be responsible for the protection and privacy of your information which you provide while visiting such sites. Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Site or the Service (Submissions), provided by you to LK² Inc. are non-confidential and shall become the sole property of LK² Inc. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Governing Law

This Agreement is entered into in Ontario, Canada. You agree that it will be governed by the laws of the Province of Ontario and any disputes arising out of this Agreement will be subject to the courts of the Province of Ontario and the federal courts applicable within the Province. If any provision in this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods. Assignment

If SeeWho’sNext obligations hereunder are assumed by a third party, SeeWho’sNext shall be relieved of any and all liability under this Agreement.
